Terms and Conditions ? Truckin? Life Promotion

1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry. Entry must be made via SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure.

2. Entry is open to all Australian residents 18 years and over who fulfil all the entry requirements set out herein. Employees, including all retail staff of authorised Mercedes- Benz Australia Pty Ltd, Truckin? Life Magazine and their immediate families, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.

3. The promotion commences at 12.01 am on 20.01.09 (AEST) and concludes at 11.59pm on 04.11.09 (AEST). The Major Prize Draw will take place at 11.30 am on 06.11.09 at Ground Floor 2-6 Glenferrie Road, Malvern VIC 3144. The first (1) eligible entrant drawn will win the Major Prize. Winners will be notified by telephone, SMS and mail within 2 days of the draw date and their name and locality will be published in the April Edition of Truckin? Life Magazine (approx on sale date 25th March 2009). All reasonable steps to notify winners of the results of draw will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.

4. To enter, eligible entrants must, during the promotional period, purchase a Truckin? Life Magazine valued at $7.95 (RRP inc GST) from a participating retail store. On the Truckin? Life Magazine the promotion will be advertised and entrants will be given a question they are to answer. The question will relate to a music CD they would have received in the December 2008 edition of the Truckin? Life Magazine.

5. Eligible entrants must then enter by:

a. Sending an SMS to 19700082 containing their answer, full name and address. The required format for SMS entries is ?ANSWER? + ?ENTRANT?S NAME + ENTRANT?S FULL ADDRESS + TRUCK DRIVEN IF APPLICABLE.? Entrants entering the promotion by SMS must have the bill payer?s permission to enter the promotion or their entry will be invalid.

6. SMS messages must be sent from a mobile phone handset and be identified by a MSISDN for security reasons (unique mobile SIM number) to be eligible. Any form of automated entry using the Internet or any other device or software is invalid. Max SMS cost $0.55 (including GST). Premium carriers' SMS costs apply in addition to SMS cost to enter the promotion. Any SMS entries submitted after the promotion period has closed will not be included in the promotion and will be charged $0.55 cents (including GST). The charges for all SMS entry services will appear on each entrant's next mobile phone bill. All queries relating to mobile bills should be directed to the entrants' mobile or telephone carrier.

7. A reply SMS will be sent to each entrant submitting an entry by SMS immediately after their entry has been received confirming their entry has been successfully received. If an SMS entry is not successful a ?try again? message will be sent to the entrant. The ?try again? message will prompt the entrant to resubmit their SMS entry in the required form. If the entrant elects to resubmit their SMS entry, the entrant will be charged an additional $0.55 cents (including GST). The entrant will also be provided with a 1300 customer support number.

8. Entrants can only enter in their own name. The Promoter reserves the right to request proof of residency, proof of age identification (to the Promoter?s satisfaction in its discretion) and the bill payer?s consent to the entrant entering the promotion before issuing a prize.

9. Multiple entries will be accepted but are limited to three entries per day per mobile number. On each occasion eligible entrants must fully comply with the entry requirements applicable to their method of entry into the promotion. The judge?s decision to disqualify an entry is final and no correspondence will be entered into.

10. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the promotional period. SMS entries will be deemed to be accepted at the time of receipt and not at the time of transmission.

11. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

12. Monthly Prize Draws will be conducted as listed in the table below. The first eligible entry randomly drawn from all eligible entries received up until the draw time will receive the Minor Prize. The Minor Prize is a Thomas Cook Oilskin Jacket with unique Freightliner embroidery and a 12 music CD pack. Each minor prize pack is valued at $450. There will be a total of 10 minor prizes awarded, with a total prize pool valued at $4500. Winners will be notified via SMS, telephone, mail within 2 days of the draw date and their name advertised in the Truckin? Life magazine as per the table listed below. Winner drawn on the 27/02/09 will also be published in The Australian on the 06/03/09.

13. Major Prize Draw:
The Major Prize Draw will take place at 11.30 am on 06.11.09 at Ground Floor 2-6 Glenferrie Road, Malvern VIC 3144. The first (1) eligible entrant drawn will win the Major Prize. Winners will be notified by telephone, SMS and mail within 2 days of the draw date and their name and locality will be published in the December Edition of the Truckin? Life Magazine.

The Major prize is a trip for 2 to the 2010 Tamworth Country Music Festival. The prize includes:
- Return economy airfares for 2 people from their nearest capital city to Melbourne, Victoria.
- Return airport transfers to and from Albury
- 2 economy tickets on the ?Tamworth Train? from Albury to Tamworth
- 9 nights accommodation on the ?Tamworth Train?
- $2000 spending money

Total maximum Major Prize value is $10,000 (depending on winners state of departure).

The entire prize must be taken during the ?2010 Tamworth Country Music Festival? from 22.01.2010 ? 31.01.2010 inclusive. Therefore all flights and accommodation will be based around the festival dates and no extension of these travel dates will be permitted. The winners of the Prize will not accrue any frequent flyer points from taking the prize. All components of the Prize must be taken together. Accommodation at all hotels and travel is subject to booking, accommodation and flight availability at the promoters? discretion. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. Travel and accommodation is to be arranged by the Promoter and/or a licensed travel agent nominated by the Promoter

14. Total Maximum Prize Pool value is ??????$14,500 (Recommended Retail Price including GST) Prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.

15. Each winner is responsible for obtaining (and the cost of obtaining) medical advice prior to taking the prize and obtaining any recommended vaccinations and immunisations in the manner required before travelling. Taking the travel prize is subject to any prevailing terms and conditions of accommodation/transport/services/ transfers/ or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, is unable to use any element of the prize as stated for whatever reason.

16. All other costs including additional meals, additional flights, laundry services, transport to and from departure point, taxes (including applicable airport, arrival and departure taxes), insurance (and any applicable insurance excesses), travel insurance, passports and visas and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winners. This prize cannot be used in conjunction with any other discounts or special offers. Use of any passes and vouchers issued as part of the Prize are subject to prevailing terms and conditions of use and passes are only valid for use within the stated duration on the passes or vouchers issued or the duration of the winners? holiday, whichever is earlier. Any tickets or passes which remain unused after the completion of the Prize holiday shall be deemed null and void.

17. If within 14 days of the major prize draw the winner cannot be contacted then the Promoter may conduct such further draws as are necessary. If necessary, in order to distribute the prize, an unclaimed prize draw will take place at the same time and location as the original draw on 27.11.09 in order to distribute any Major Prize unclaimed by that date subject to any written directions given under relevant State or Territory legislation. If necessary, in order to distribute a minor prize, an unclaimed prize draw will take place at the same time and location as the original draw on 06.02.10 in order to distribute any Minor Prize unclaimed by that date subject to any written directions given under relevant State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winners will be notified by telephone, in writing and their name and locality will be published in the January Edition of Truckin? Life Magazine (approx Date 25.12.09) for major prize and March Edition of Truckin?
Life Magazine (approx date 25.02.10) for minor prizes.

18. If for any reason any element of a prize becomes unavailable for any reason beyond Promoter?s control then a similar prize element of equal or greater value will be awarded to the winner in lieu.

19. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agents associated with this promotion take no responsibility for prizes damaged or lost in transit.

20. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter?s legal rights to recover damages or other compensation from such an offender are reserved. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

21. Caution: any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.

22. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

23. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions given under State or Territory legislation.

24. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

25. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, War; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

26. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

27. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants? personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the
Promoter may use entrants? personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner?s name, and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter.
